Under United Kingdom legislation for the disposal of radioactive waste fom hospital premises (IRR99), what is the situation regarding "Exemption Orders"—do they still exist?

I understand you need some information on exemption orders made under the Radioactive Substances Act 1993 (RSA 93), which covers waste disposal in hospitals. RSA 93 regulates the keeping and use of radioactive materials and controls the disposal and accumulation of radioactive wastes. In many practical situations involving radioactive substances, the quantity and form of the materials being used, the nature of the processes involved, and the disposal routes for wastes mean that the radiological impact is low. In suitable cases, and subject to appropriate conditions, exemption from specified provisions of the Act may be granted by means of exemption orders made under sections 8, 11, or 15 of the Act. The exemption relating to hospitals is contained in the following orders:

  • The Radioactive Substances (Hospitals) Exemption Order 1990 SI 1990 No 2512 and
     
  • The Radioactive Substances (Hospitals) (Amendment) Exemption Order 1995 SI 1995 No 2395

This order applies to private and National Health Service hospitals and provides conditional exemption from registration for radioactive material kept for the purposes of medical diagnosis, treatment of patients, or supply to another hospital. It also gives conditional exemption from authorisation in respect of the disposal of wastes arising from the administration of very low doses of radioactive materials to patients.
